Please read these Terms and Conditions carefully. By using Pokhara Sky Sports or signing up for an account, you are agreeing to these Terms. This is a legal agreement. We will start with the basics, including a few definitions that should help you understand this agreement. Pokhara Sky Sports is a club membership service offered through the URL www.pokharaskysports.com (we will refer to it as the "website"). You must accept and agree to abide by the Terms and Conditions before accessing or using the Electronic Channels or availing of any of the facilities, products or services offered on the Electronic Channels. Please note that by clicking on "Sign Up" it will be deemed that you have read and understood the Terms and Conditions and that you agree to accept and abide by the Terms and Conditions.
Please read the Terms and Conditions carefully. The access and use of the Electronic Channels mean that you agree to accept and abide by the Terms and Conditions. The points below define the terms and conditions under which you are allowed to use the services of Pokhara Sky Sports, and how we will treat your account while you are a Member. If you have any questions about our terms, feel free to contact us.
In order to use the services of Pokhara Sky Sports, you must:
- be at least eighteen (18) years old and able to enter into contracts; complete the registration process;
agree to the Terms;
- and provide true, complete, and up to date contact information. By using the services of Pokhara Sky Sports, you represent and warrant that you meet all the requirements listed above, and that you will not use its services in a way that violates any laws or regulations. (Representing and warranting is like making a legally enforceable promise.) Pokhara Sky Sports may refuse service, close accounts of any users, and change eligibility requirements at any time.
The Term begins when you sign up for Pokhara Sky Sports and continues as long as you use the Service. Clicking the button and entering your first name, last name and mobile means that you have officially "signed" the Terms. If you sign up for Pokhara Sky Sports on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms on their behalf.
3. Closing Your Account
You or Pokhara Sky Sports may terminate this Agreement at any time and for any reason by giving Notice to the other party. We may suspend our Service to you at any time, with or without cause. If we terminate your account without cause, we will refund a prorated portion of your monthly membership or reimburse you for unused Credits. We will not refund or reimburse you if there is cause, like a violation of these Terms or our Acceptable Use Policy. Once terminated, we may permanently delete your account and all the data associated with it from our Website. If you do not log in to your account or do not utilize our service for 12 or more months, we may treat your account as "inactive" and permanently delete the account and all the data associated with it.
We may change any of the Terms by posting revised Terms and Conditions on our Website and/or by sending an email to the last email address you gave us. Unless you terminate your account within ten (10) days, the new Terms will be effective immediately and apply to any continued or new use of Pokhara Sky Sports. We may change the Website, the Service, or any features of the Service at any time.
5. Account and Password
You are responsible for keeping your account member id and password confidential. You are also responsible for any account that you have access to, whether or not you authorized the use. You will immediately notify us of any unauthorized use of your accounts. We’re not responsible for any losses due to stolen or hacked passwords. We do not have access to your current password, and for security reasons, we may only reset your password.
6. Account Disputes
We do not know the inner workings of your organization or the nature of your personal relationships, and we do not arbitrate disputes over who owns an account. You will not request access to or information about an account that is not yours and you will resolve any account-related disputes directly with the other party. We decide who owns an account based on the content of the emails in that account, and if multiple people or entities are identified in the content, then we will rely on the contact information listed for that account.
7. Account Transferability
The account made won’t be transferable to others. It is a personal account and if anyone feels the need of making an account, it must be done by them.
8. Membership options
Pokhara Sky Sports has two membership options: Guest membership or paid membership. Thus, you can either be our guest member or our paid member. For becoming a paid member you must subscribe our membership package which is available in our website.
9. Payment for membership
The payment for membership can be done through either bank deposit or cash payment. Bank deposit can be done in Shangrila Bank at account no. 00100800187387000002 and the fund can be loaded in your Pokhara Sky Sports account by submitting the scanned deposit slip or photo of it.
10. Procedure to use membership
There are certain privileges and discounts available in the membership packages as per the membership package and membership type available.
11. Kinds of card available
There are three basic kinds of card available in Pokhara Sky Sports: Guest card, Membership card, and Top Up card.
12. Issuance of Guest card
Guest members are the one who sign up and make their personal account at Pokhara Sky Sports website. Guest card will be issued to those members only after they inform us about its requirement and pay the charges for it.
13. Issuance of Membership card
Membership card will be available to the customers after they subscribe for any membership package. It is provided for free.
14. Issuance of Top up card
Top up card will be issued to the pay as you go customers. They shall be providing certain amount of money to which a top up card will be issued.
15. Card Dispatch
Any kind of card shall be dispatched in Pokhara Sky Sports premises in the reception.
16. Card compulsion
The card is necessary for all kind of members to use the services of Pokhara Sky Sports. It is mandatory to bring the membership card while coming to Pokhara Sky Sports for utilizing the services. If the silver/gold/platinum members don’t bring their membership card then they won’t be able to utilize the privileges and discount amount in their membership card and shall be treated as guest members. In few cases/circumstances (like for platinum members) this kind of compulsion will not be made.
17. Card responsibility
The card is the complete responsibility of the member/customer after it is dispatched to them. Pokhara Sky Sports will not be liable for its damage or theft.
18. Card loss (theft/damage/loss)
In case if they lose their cards, or the cards get damaged by any means one should immediately inform us so that the lost/stolen cards can be blocked. Pokhara Sky Sports bears no responsibility for any actions incurred due to failure to notify about the lost/stolen cards.
19. Issuance of new card (theft/damage/loss)
After reporting of the lost or damaged card, the member shall be provided with a new card with the same registration id. However, the member should pay the designated charges for the issuance of a new card. The member is required to pay every time for the issuance of new card whatever the case may be (loss/destruction).
FUND LOAD (TOP UP)
20. Top up limit
A costumer or a user cannot top up more than Rs.9, 99,999/- at a time.
21. Withdrawal limits
A user cannot withdraw more than Rs.1, 00,000/- per day from his/her account.
22. Top up Procedure
The top up can be done through either cash payment or bank deposit. Our banking details are available in the top-up section on our website. Whereas if you want to do cash payment, it can be done through depositing cash in any of the cash counters of Pokhara Sky Sports. The remaining balance of your account can be withdrawn from our cash counters upon exit provided that it is within the daily withdrawal limits.
23. Top up time
Cash payment will be loaded to your account as soon as you do the payment whereas bank deposits made in office hours will be made within 1 hour or if done besides office hours, it will be done the next day in the first hour.
24. To whom the transfer can be done
The fund in your Pokhara Sky Sports account can be transferred only to any verified member of Pokhara Sky Sports.
25. Transfer amount limit
A member cannot transfer more than Rs 99,998/- to other verified members of Pokhara Sky Sports.
26. Place where the refund is made from
The remaining balance in your account/ top up card shall be made from reception/cash counter of Pokhara Sky Sports account.
27. Refund if the card is held by other person and not by the member
If the card is held by other person and not by the member:
• If the balance amount is less than or equal to Rs 1000, the refund shall be provided to the person. The name and phone number of the person will be kept in the register and should be signed by the person.
• If the balance amount is more than Rs 1,000, the member shall be confirmed regarding the refund to be made to the person or not. The information regarding the person obtaining the refund from the cash counter shall be recorded and should be signed by the person accordingly.
28. Booking method and time
The booking can be made online through website in Pokhara Sky Sports. The booking can be made anytime and is 24 hours available. The invoice will be issued to the members on the day and time booked for the service. However, the system will issue a confirmation for their bookings.
29. Booking criteria
Booking feature will be available to you only if your account has some amount of money.
30. Booking cancellation
For every booking cancellation, some amount of cancellation charge shall be deducted from your account.
Pokhara Sky Sports will announce promotional special discounts and rewards through website. The accumulated reward points of each member can be used by the member after reaching certain points. The reward points accumulated should be used within the Fiscal Year. Rewards are also given to those members who buy things regularly from website. The rewards are inclusive of tax and applicable charges.
Pokhara Sky Sports provide two kinds of Locker: changing room lockers and platinum lockers.
31. Changing room lockers
The changing room lockers are for anyone who uses the changing room for storage of personal belonging during their visit at Pokhara Sky Sports premises. Any member who requires using the lockers can get a key from our reception counter, then provide a locker deposit and utilize the lockers. The keys of those lockers can be kept safely by leaving it to the reception or you can take it with yourself but we are not liable/accountable for damage or loss of belongings in it. A member needs to return the keys of the respective lockers upon exit from the club and the locker deposit shall be again refunded to them.
32. Platinum Lockers
The platinum lockers shall be provided to the platinum members of Pokhara Sky Sports. The keys of the platinum lockers need not be returned to the counter and the member might use the lockers as they want to. The safety and security of the platinum lockers and the belongings in it will be the responsibility of Pokhara Sky Sports.
33. Proprietary Rights Owned by Us
You will respect our proprietary rights in the Website and the software used to provide Pokhara Sky Sports (proprietary rights include patents, trademarks, service marks, trade secrets, and copyrights).

We may view, copy, and internally distribute content from your account to create algorithms and programs ("Tools") that help us spot problem accounts. We use these Tools to find Members who violate these Terms or laws. For example, we study data internally to make our Project smarter and create better experiences for our subscribers.
RULES AND ABUSE
37. General Rules
You promise to follow these rules:
You will not violate our Acceptable Use Policy, which is part of this Agreement. We also may suspend or terminate your account if we determine, in our sole discretion, that you are either: A person that has publicly made a comment or statement, or otherwise publicly made known a position, including by membership in an organization as discussed above that could be reasonably perceived as Hateful Content or A Threat of Physical Harm.
A person or organization that has acted in such a way as could be reasonably perceived to support, condone, encourage, or represent Hateful Content or A Threat of Physical Harm.
If you violate any of these rules, then we may suspend or terminate your account.
38. Reporting Abuse
If you think anyone is violating any of these Terms, please notify us immediately.
39. Compliance with Laws
You represent and warrant that your use of Pokhara Sky Sports will comply with all applicable laws and regulations. You are responsible for determining whether our Services are suitable for you to use in light of any regulations.
40. Limitation of Liability
To the maximum extent permitted by law, you assume full responsibility for any loss that results from your use of the Website and the Services, including any downloads from the Website. We and our Team will not be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they’re based on negligence or we’ve been advised of the possibility of those damages. Our total liability for all claims made about the Service in any month will be no more than what you paid us for the Service the month before.
41. No Warranties
To the maximum extent permitted by law, we provide the material on the Website and the Service as is. That means we do not provide warranties of any kind, either express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. Since people use Pokhara Sky Sports for a variety of reasons, we can’t guarantee that it will meet your specific needs.
You agree to indemnify and hold us and our Team harmless from any losses, including attorney fees that result from any claims you make that aren’t allowed under these Terms due to a “Limitation of Liability” or other provision. (Indemnity is an agreement to compensate someone for a loss.) You also agree to indemnify and hold us harmless from any losses, including attorney fees that result from third-party claims that you or someone using your password did something that, if true, would violate any of these Terms.
We and our Team aren’t responsible for the behavior of any advertisers, linked websites, or other Members.
44. Entire Agreement
ADDITIONAL TERMS AND CONDITIONS
45. Use of appropriate clothes and shoes
Appropriate clothes and shoes must be worn by the customer while using any of the services at Pokhara Sky Sports. Failure to comply with appropriate clothing and shoes standards might result in the club disallowing a member to utilize its services despite having paid for it.
46. Responsibility of loss of belongings
It is the customer’s responsibility to protect their belongings either on the lockers or elsewhere throughout their time in Pokhara Sky Sports Club. There are security guards and CCTV cameras in the premises to monitor the visitor’s activities in the premises however, this doesn’t mean one can be irresponsible of their personal belongings. Pokhara Sky Sports is in no way responsible for any issues arising from inappropriate handling of personal belongings or loss of any kind.
47. Opening – Closing time
The opening time of Pokhara Sky Sports is at 7:00AM and its closing time is at 8:00PM.
48. Health Issues
The customer shall provide the club with the prior information regarding any personal health issues so that they can be provided adequate knowledge about the effect our services might have on their health. If they suffer from any kind of chronic diseases which is not suitable for any kind of services we provide, they must have a proper consultation with their doctors and should do as per the doctor’s advice. Some members with adverse health conditions may not be allowed to use the services on our premises for safety reasons. The use of any service we provide is the choice of the customer and one should be aware of the consequences resulting from participation in any activity offered in our premises. We have no liability if any such health issues or unfortunate event occurs due to any kind of reason during your visit to our club. All members are advised to follow hygienic practices in order to keep themselves and others free of any harm.
49. Harassment or Abuse
Any kind of misbehavior in terms of sexual harassment, abuse or otherwise will not be tolerable to our personnel or staffs by our customers or to any member visiting the club premises and vice versa. Immediate action will be taken against anyone behaving inappropriately to anyone. Depending upon the situation the Pokhara Sky Sports management might terminate the membership, ban the member from the club or fire a staff involved in such behavioral mishaps.
Where there is a conflict between these Terms and the Additional Terms, the Additional Terms will control. The additional terms can be introduced at any point on the website and will be effective immediately upon introduction.
